End User License Agreement (EULA)

This End User License Agreement (the “Agreement”) is a legal agreement between you (referred to as the “User” or “You”) and SmartBlogger.ai (referred to as the “Licensor” or “We”) for the use of the SmartBlogger.ai WordPress plugin (referred to as the “Software” or “Plugin”), including any associated media, printed materials, and online or electronic documentation. By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not use the Software.

1. License Grant:
Subject to the terms and conditions of this Agreement, the Licensor hereby grants you a non-exclusive, non-transferable, revocable license to use the Software solely for your own personal or business purposes. This license allows you to install and use the Software on two websites or WordPress installations.

2. Ownership and Intellectual Property:
The Licensor retains all right, title, and interest in and to the Software, including any intellectual property rights associated with the Software. You acknowledge that this Agreement does not grant you any ownership or rights in the Software, except for the limited license rights expressly set forth herein.

3. OpenAI GPT-3.5:
The Software may utilize or integrate with OpenAI’s GPT-3.5 model or other OpenAI technologies. You understand and agree that your use of the Software is subject to the terms and conditions set forth by OpenAI, including any limitations or restrictions imposed by OpenAI’s usage policies and guidelines. You further acknowledge that OpenAI is not a party to this Agreement and shall have no liability or responsibility for the Software or its use.

4. Restrictions:
You shall not, directly or indirectly:
a) Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Software;
b) Remove, alter, or obscure any proprietary notices or labels on the Software;
c) Use the Software in a manner that violates any applicable laws, regulations, or third-party rights;
d) Rent, lease, lend, sublicense, distribute, or otherwise transfer the Software to any third party without the prior written consent of the Licensor.

5. Support and Updates:
The Licensor may provide support services and updates for the Software at its sole discretion. These services and updates may be subject to additional terms and fees, which will be communicated separately.

6. Limitation of Liability:
To the maximum extent permitted by applicable law, the Licensor shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of the Software, including but not limited to loss of profits, data, or business opportunities.

7. Termination:
This Agreement is effective until terminated. The Licensor may terminate this Agreement at any time without notice if you fail to comply with any provision of this Agreement. Upon termination, you must cease all use of the Software and destroy all copies in your possession or control.

8. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of [Your Jurisdiction]. Any legal action or proceeding arising out of or relating to this Agreement shall be exclusively brought in the courts located within [Your Jurisdiction], and you consent to the personal jurisdiction of such courts.

9. Entire Agreement:
This Agreement constitutes the entire agreement between you and the Licensor regarding the subject matter hereof and supersedes all prior or contemporaneous agreements, understandings, and representations, whether oral or written.

By installing or using the Software, you acknowledge that you have read and understood this Agreement and agree to be bound by its terms and conditions.
